5VR.AI PRIVACY POLICY

This Privacy Policy ("Policy") explains what personal information we collect, how we use and share it, and the choices you have in connection with your use of 5VR.AI application and site (collectively "5VR.AI").

By using the 5VR.AI, you acknowledge that you have read and understood this Policy. If you do not agree with our practices described in this Policy, please do not use 5VR.AI.

This Policy may change from time to time. Any changes we make to this Policy will be posted on 5VR.AI and, to the extent required by applicable law, we will notify you about material changes. Changes to this Policy are effective as of the stated "Last Updated" date. We recommend that you check the Policy periodically for any updates or changes.

1. Information We Collect

Information You Provide. When you register for 5VR.AI, you provide personal information, including a valid email address and your name. This also includes any communications with our customer support team.

Information We Collect Automatically. When you access or use 5VR.AI, we may automatically collect information about your activity and device. This includes device and usage data, such as account ID, push token, IP address, device type, operating system, browser settings, log data, session duration, and referring/exit URLs.

Video and Content Data. The core function of 5VR.AI is the collection and licensing of video and audio recordings of household activities. Recordings are uploaded to and stored on our secure servers for processing and quality review. When you use 5VR.AI to record, we collect:

  • Video and audio recordings of the activities you perform (mentioned in the 5VR.AI Terms of Service as "Content").
  • Metadata associated with recordings at the time of capture, including timestamps, duration, and device information.
  • Environmental data captured incidentally in recordings, such as background audio or visual elements within your home.
  • Task completion data and performance metrics.

2. Data That is Not Personal Information

Content Requirements. All Submissions must comply with the 5VR.AI Terms of Service ("Terms of Service") and Submission Spec. Content must not include any individual's face, voice, or other biometric identifiers, or any personally identifiable information, including identification documents or financial information.

We may reject any Submission that does not meet these requirements

De-Identification. Before any accepted recording is licensed, 5VR.AI applies a de-identification process to remove user-identifying information. This may include:

  • Removing metadata that could identify the contributing user, such as device identifiers, timestamps, and location data.
  • Additional steps to confirm the recording contains no personal data as defined under applicable law.

Your Choices Regarding Video Recordings. Because licensed recordings are de-identified and no longer constitute personal information, the following limitations apply:

  • Pre-submission. You may review and delete any recording before submitting it.
  • Accepted and licensed recordings. Once a Submission has been accepted, de-identified, and licensed, we cannot recall or delete it. Because it no longer contains personal information, rights with respect to personal information under applicable law do not apply to licensed video Content.

De-identified video licensed to AI and robotics partners is not personal information and is not subject to this Policy.

3. Purposes of Using Your Personal Information

We use the information we collect to:

  • Provide and Operate 5VR.AI. To create and maintain your account, enable you to record and submit video content, process, curate, and quality-check submitted recordings, and facilitate payments to you for accepted Content.
  • Improve and Develop 5VR.AI. To analyze usage patterns to improve 5VR.AI functionality and user experience.
  • To Communicate with You. To communicate with you about your submissions, account status, and updates.
  • Legal compliance and business record-keeping. To maintain appropriate business records, comply with lawful requests by public authorities and applicable laws and regulations.
  • Safety, security, and fraud prevention. To detect, assess, and prevent fraudulent or inappropriate activities, verify or authenticate information provided by users, and to enforce the Terms of Service and this Policy.

4. How We Share Your Personal Information

Service Providers. We share personal information with service providers that help us operate 5VR.AI, including cloud storage and hosting, sign-in authentication providers, app distribution platforms, fraud detection, cybersecurity, and legal and financial services. Consistent with applicable legal requirements, we take appropriate technical and organizational measures to require third parties to adequately safeguard personal information and only process it in accordance with our instructions.

Fiverr (for Payment Processing). Your use of 5VR.AI is conditioned upon creating an account on Fiverr International Ltd. ("Fiverr") platform (www.fiverr.com). All information you provide in connection with your Fiverr account, including payment details, is governed by Fiverr's Privacy Policy and Fiverr's Terms of Service. 5VR.AI does not process or store your Fiverr credentials or payment information. We encourage you to review Fiverr's Privacy Policy before creating a Fiverr account.

Business Transfers. In connection with a merger, acquisition, reorganization, sale of all or a portion of our assets, or insolvency proceeding, your information may be transferred to a successor entity. We will notify you of any such transfer and any material changes to this Policy that result from it.

Legal Requirements. We may disclose your information as required by law, subpoena, or court order, or when we reasonably believe disclosure is necessary to protect the rights, property, or safety of 5VR.AI, our users, or others.

5. Data Retention

We apply a general rule of keeping personal information only for as long as is required to perform the purpose for which it was collected. However, in some circumstances, we will retain your personal information for longer periods of time. We will retain personal information for the following purposes:

  • as long as it is necessary and relevant for our operations, e.g. so that we have an accurate record of your dealings with us in the event of any complaints or challenges;
  • in relation to personal information from closed accounts to comply with applicable laws, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigation, enforce the Terms of Service and take other actions as permitted by law;
  • to comply with statutory or other legal obligations; and
  • if and to the extent necessary, we need it to preserve evidence within the statutes of limitation.

6. Your Rights and Choices Regarding Your Personal Information

The following rights apply to your personal information as described in Section 1 (account data and automatically collected data). These rights do not extend to de-identified video recordings that have been accepted and licensed, as described in Section 2.

You may have the following rights, depending on the jurisdiction in which you reside and subject to applicable law and certain exceptions:

  • Access. Request information about the personal information we have collected about you, the purposes for which we collect it, and the categories of third parties with whom we share it.
  • Deletion. You have the right to request deletion of your personal information, subject to certain legal exceptions, by deleting your account in 5VR.AI. You may also request deletion of rejected video recordings (those that failed quality and content review) by contacting us at [email protected]. Accepted recordings cannot be deleted.
  • Rectification. You have the right to correct inaccurate personal information you provided us.
  • Opt-Out of Targeted Advertising. To the extent 5VR.AI engages in targeted advertising using your personal information, you have the right to opt out. Note: this right does not apply to de-identified video recordings licensed under Section 2, which are not personal information.
  • Non-Discrimination. You have a right not to be discriminated against for exercising your rights.

To exercise your rights, please contact us as stated in the "Contact Us" section. We will verify your request using the information associated with your account.

7. Deleting Your Personal Information

You may have the right to request deletion of your personal information, subject to applicable law and the limitations described in Section 6.

To delete your account, go to Settings → Delete Account in the app, or contact us via Support by opening a Customer Relations ticket.

8. Security

We implement technical and organizational measures in order to maintain the security of the 5VR.AI, our services and personal information and in preventing unauthorized access, loss, misuse, alteration, destruction or damage to it through industry standard technologies and internal procedures. We contractually ensure that any third party processing your personal information equally provides for confidentiality and integrity of your data in a secure way. However, the transmission of data via the internet is not completely secure, and although we will do our best to protect your personal information, we cannot guarantee the security of your data transmitted to 5VR.AI. Once we have received your data, we will use strict procedures and security features to try to prevent unauthorized access.

Users who have registered to 5VR.AI agree to keep their password in strict confidence and not disclose such password to any third party.

9. Minors Under 18

5VR.AI is intended for users who are at least 18 years of age or older and of legal age to form a binding contract, as noted in the Terms of Service.

We do not knowingly collect, use, or disclose personal information from minors under 18. If we learn that we have collected personal information from a minor without verifiable parental consent, we will take steps to delete such information promptly.

10. Your Fiverr Account and Payments

To receive payment on submitted Content, Individual Contributors must create an account on Fiverr's platform.

All information you provide when creating or managing your Fiverr account, including your name, and bank or payment account details, is collected and controlled by Fiverr International Ltd., 8 Kaplan St., Tel Aviv, Israel, and governed exclusively by Fiverr's Privacy Policy and Terms of Service.
